Roamkin Vehicle Rental Agreement
Version 1 · Last updated 12 October 2026
1. Contract documents and platform role
1.1 The completed rental details, the confirmed booking summary, the condition reports and the protection terms supplied before acceptance form part of this agreement. Mandatory law takes priority over this agreement. A booking detail that has been expressly agreed takes priority over a general clause. No new fee, exclusion or retrospective change applies after acceptance unless the parties agree to it.
1.2 Unless the booking expressly identifies Roamkin as the supplier, the Owner supplies the vehicle and the Renter rents it from the Owner. Roamkin arranges the booking and provides payment, deposit and claims administration services. Roamkin is not an insurer, does not guarantee insurance cover or the outcome of any claim, and does not remove any duty imposed by law.
1.3 The named deposit custodian must comply with section 6. Where the Owner holds the deposit, the Owner is responsible for refunding it and Roamkin facilitates the dispute process. The custodian, and whether the deposit is collected or pre-authorised, must be disclosed before payment. If the custodian is not identified, no deposit may be collected until this is clarified.
2. Eligibility and authorised drivers
2.1 The Renter and every approved additional driver must hold a current licence that is valid for the vehicle and the place of use, meet the eligibility and insurer requirements disclosed before booking, and give accurate identity and contact information. Verification may be required before handover. A booking does not authorise an unlicensed or unapproved driver.
2.2 Only drivers named in the booking and approved by the Owner and Roamkin may drive the vehicle. The Renter must ensure approved drivers comply with this agreement and, to the extent permitted by law, is responsible for their use of the vehicle. The Renter must not transfer the booking, lend the vehicle or sub-rent it without prior written approval.
3. Handover and condition evidence
3.1 The Owner must be entitled to rent out the vehicle and must supply it safe, roadworthy and legally compliant, with the required documents, the agreed equipment and cover appropriate for the booked use. The Owner must disclose known faults and material restrictions. Insurance and protection details must be supplied before the rental starts; blank fields do not create cover.
3.2 Before driving, the Owner and the Renter must record the exterior, interior, tyres, glass, visible damage, mileage, fuel or battery level, warning lights, keys and supplied equipment. Dated photos or video and a signed or electronically accepted condition report must be linked to the booking, and each party keeps a copy.
3.3 The Renter must report discrepancies before departure, or as soon as possible if discovered later. Accepting the vehicle is not a waiver of hidden defects or statutory rights. The Renter must not drive a vehicle that appears unsafe and must contact the Owner and Roamkin. Missing condition evidence does not automatically prove that the Renter caused damage.
9. Protection of Roamkin and dispute resolution
9.1 To the extent permitted by law, the Renter must reimburse Roamkin for reasonable, proven third-party claims and direct costs caused by the Renter's or an approved driver's unlawful use, fraud, negligence or material breach. This does not cover loss caused by Roamkin's or the Owner's own fault, or liability that cannot lawfully be transferred. Roamkin must notify the Renter, provide evidence, mitigate the loss and allow reasonable participation, and must not bind the Renter to an unreasonable settlement.
9.2 Roamkin is responsible for its own services and conduct and does not assume the Owner's obligations solely because it arranges the booking. No clause excludes mandatory consumer rights or liability that cannot lawfully be excluded, including prohibited exclusions for gross negligence. This agreement does not make Roamkin's assessment final or prevent a court, regulator or insurer from determining a matter.
9.3 Complaints go to the Roamkin support contact in the rental details, quoting the booking reference and evidence. Roamkin must acknowledge a complaint within two business days and seek a reasoned resolution within ten business days. The deposit deadlines in section 6 still apply. The parties may agree to mediation. Zimbabwean law governs rentals in Zimbabwe, and disputes may go to a competent court or consumer authority. There is no mandatory private arbitration and no waiver of statutory remedies.
10. Records, notices and acceptance
10.1 Identity, licence, payment, condition and incident records may be processed for booking administration, verification, fraud prevention, claims and legal compliance under applicable data law and the privacy notice supplied before acceptance. They may be shared with the parties, payment providers, insurers, police or professional advisers where necessary and lawful. Any tracking must be disclosed with its purposes and access restrictions. This agreement is not consent to unrelated marketing or unrestricted surveillance.
10.2 Contract notices use the booking's recorded email, telephone or in-app contact and are retained with the booking. When connectivity is unavailable, either party may preserve photos and records offline and submit them as soon as possible, using another channel for urgent incidents. Electronic acceptance must record the agreement version, booking reference, accepting person and date/time, and a downloadable or emailed copy must be provided.
10.3 Changes must be agreed in writing. If a clause is unlawful or unenforceable, the remainder continues only so far as it is lawful and workable. No failure to enforce is a permanent waiver. Mandatory legal rights are unaffected.
