Diaspora Vehicle Custody and Management Agreement
Version 1 · Last updated 12 October 2026
1. Purpose and parties
This agreement applies where a vehicle owner living outside Zimbabwe (the Owner) places a vehicle in Zimbabwe in the custody of a local manager, who may be a nominated family member, a Roamkin-approved fleet manager or another agreed custodian (the Custodian), to be listed and rented through Roamkin.
Roamkin is a marketplace. Unless a separate written agreement says otherwise, Roamkin is not the Custodian and does not take possession of the vehicle.
2. Ownership and authority
The Owner remains the legal owner at all times. The Owner confirms they hold valid title and authorises the Custodian in writing (a power of attorney or signed authority) to hand over, receive back and, where agreed, service the vehicle and deal with Renters and Roamkin. The Custodian has no right to sell, pledge or transfer the vehicle.
3. Custodian duties
The Custodian must:
- keep the vehicle safe, roadworthy, licensed and insured as required
- carry out handovers and returns with full digital condition checks
- keep the vehicle clean and arrange routine servicing approved by the Owner
- respond to Renters, Roamkin and the Owner promptly
- report accidents, theft, damage, fines and disputes immediately
- keep accurate records of income, costs and mileage
4. Owner duties
The Owner must keep valid registration, licensing and insurance appropriate for rental use, fund agreed maintenance, provide accurate contact details, and complete verification and tax obligations in both countries as applicable.
5. Fees, income and accounts
Any management fee payable to the Custodian is agreed in writing between Owner and Custodian and should be disclosed to Roamkin. Payouts are made to the account verified for the listing, as described in the Payments, Payouts and Fees Policy. Statements of bookings, fees and deductions are available in the app.
6. Security deposits and claims
Deposit claims must follow the Security Deposit and Damage Policy and be supported by the condition evidence. Custodians must not retain or deduct deposit money except as that policy allows.
7. Insurance and risk
The Owner is responsible for adequate insurance. The Custodian must not let the vehicle be used where cover is not in force. Responsibility for loss while in the Custodian's care depends on the written arrangement between Owner and Custodian and on the law.
8. Ending the arrangement and recovery
The Owner may end the arrangement and have the vehicle returned on reasonable notice, after confirmed bookings are completed. Roamkin may suspend a listing where the Custodian is in breach, safety is at risk, or ownership or authority is disputed.
Disputes between Owner and Custodian are for them to resolve; Roamkin will cooperate in good faith and may provide booking records where lawful.
